Import and export inspection and quarantine supervision and management practices of aquatic products

Chapter I General Provisions

In order to strengthen inspection and quarantine of import and export of aquatic products and supervision to ensure quality and safety of import and export of aquatic products, to prevent animal disease spread incoming border to protect the safety of fishery production and human health, according to "Import and Export Commodity Inspection Law" and its implementing regulations, "Entry and Exit Animal and Plant Quarantine of the PRC" and its implementing regulations, "Frontier Health and Quarantine Law" and its implementation details, "Food Safety Law" and its implementing regulations, "the State Council on strengthening food and product safety supervision and management of special provisions "and other relevant laws and regulations, formulated.

These Measures shall apply to the import and export inspection and quarantine of aquatic products and supervision.

Article The term refers to fish for human consumption of aquatic animal products and its products, including jellyfish, molluscs, crustaceans, echinoderms, the first cable, fish, amphibians, reptiles, aquatic mammals other aquatic animals, algae and other marine products and plant products and their products, not including live aquatic animals and aquatic plants and animals breeding material.

Article IV Administration of Quality Supervision, Inspection and Quarantine (hereinafter referred to as AQSIQ) shall be in charge and supervision of import and export inspection and quarantine of aquatic management.

AQSIQ in the entry-exit inspection and quarantine agencies around (hereinafter referred to as inspection and quarantine institutions) is responsible for their areas of jurisdiction and supervision of import and export inspection and quarantine of aquatic management.

Article inspection and quarantine authorities shall conduct inspection and quarantine of import and export of aquatic products, supervision and checking of import and export of aquatic products processing enterprises (hereinafter referred to as manufacturer) in accordance with regulatory requirements and the relevant provisions of the AQSIQ to implement credit management and classification system.

Article import and export of aquatic products production enterprises should be in accordance with laws, administrative regulations and relevant standards in production and business activities, social and public accountability to ensure quality and safety of aquatic products, accept social supervision, and social responsibility.

Article VII of the State Administration of Quality Supervision, Inspection and Quarantine inspection and quarantine agencies to issue import and export of aquatic products certified staff to implement the record management system, personnel shall not be issued without the filing of the certificate.

Chapter import inspection and quarantine

Imports of aquatic products shall comply with Article VIII Chinese laws, administrative regulations, the national food safety standards, as well as China and the exporting country or region signed the relevant agreements, protocols, memoranda and other required inspection and quarantine requirements and trade contracts specify the quarantine requirements.

No national standards for imported food safety of aquatic products, the consignee shall submit to the inspection and quarantine agencies of the State Council administrative department of health issued by the permit file.

Article 19 of Chinese aquatic products imported pre-packaged labels shall comply with Chinese food labeling laws, administrative regulations, rules and national technical specifications which are mandatory. Chapter III Exit Inspection and Quarantine

Article 23 The export of aquatic products from the inspection and quarantine institutions supervision, sampling, inspection and quarantine agencies to issue customs clearance that release.

Article 25 The export inspection and quarantine agencies to implement record management of aquatic farms. Export of aquatic products production enterprises should be used in raw materials from farms in the record, approved by the fishery administrative department of the fishing waters or fishing boats, and intends to enter the country or region in line with the inspection and quarantine requirements.

Article 26 The filing of export aquatic farms should meet the following basic conditions and health requirements:

(X) have a well-organized administration and management system written in aquaculture (including seed acquisition, breeding, health and epidemic prevention, drug use feeds, etc.);

Aquaculture technicians and quality inspectors should have the following conditions:

1. Familiar with and comply with quarantine laws, administrative regulations, rules and other regulations;

2. Familiar with and comply with agricultural administrative departments of the aquatic animal diseases and veterinary regulations;

3. Familiar with residues of the importing country or region relevant control regulations and standards;

4. Have some farming experience or professional secondary education with culture.

Article 27 The export of fish farms in the record the following procedures:

(A) the export of aquatic farms to the local inspection and quarantine agencies filing the application and provide relevant materials;

Article 30 The export of fish inspection and quarantine agencies to supervise and record farm management, organizational supervision and inspection, and make relevant records. Supervision, including daily supervision and inspection and annual audit and other forms.

Inspection and quarantine institutions shall on the basis of risk analysis in the filed of export of aquatic farms to implement aquatic animal diseases, pesticide and veterinary drug residues, environmental pollutants, water quality and other toxic substances monitoring, establish a sound information security risk management of aquatic product exports system.

Article 33 The export of aquatic products production and processing of aquatic products in farms should be implemented as a unit production batch management, different fish farms not the same production batch as the raw materials for production and processing. Article 34 The export of aquatic products production enterprises purchase raw materials should be established to examine records system to verify that the supply of raw materials supplied. Purchase inspection records shall be true and retention period of not less than two years.

Export of aquatic products manufacturer shall establish the factory inspection records system, the inspection of aquatic products factory inspection certificate and the security situation, accurately record the fish's name, size, quantity, production date, batch number, inspection and permit number, purchase the name and contact details, date of sale and so on.

Fish factory inspection records should be true, retention period of not less than two years.

Article 35 shall be in accordance with the export of aquatic products on the packaging requirements of the importing country or region to mark the country of destination indicated on the transport packaging or region.

Article 36 The export of aquatic products manufacturers or their agents shall be in accordance with the provisions of the AQSIQ inspection, with trade contracts, manufacturers test reports (factory qualified certificates), ship lists and other relevant documents to the inspection and quarantine institutions origin inspection.

Article 49 The export of aquatic products production enterprises of the following acts, the inspection and quarantine authorities may order the rectification to meet the requirements:

(A) for the first time due to pathogenic micro-organisms, environmental contaminants, pesticide and veterinary drug residue and other safety and health program failed, was returned to the importing country or region;

(B) continuous sampling inspection batch of product has three safety and health program failed;

(C) the sources of raw materials is unclear, batch management chaos;

(D) within one year of daily supervision and inspection found that the same non-conformity to three times;

(E) not established product traceability system.

Article 50 The import and export of aquatic products production enterprises have other violations, in accordance with relevant laws and administrative regulations shall be punished.

Article 51 inspection and quarantine institutions and their staff in the implementation of import and export of aquatic products and the supervision inspection and quarantine work, violation of laws and regulations and the provisions hereof, in accordance with the provisions of investigation.

Chapter V Supplementary Provisions

Article 52 These Measures shall be interpreted by the AQSIQ.
